As a result, special legal requirements apply.

Accredited Adoption Agencies

Intercountry adoptions may only be carried out by officially recognised and supervised adoption agencies. In Germany, there are currently six non-profit organisations operating nationwide. While they do not receive financial support from the state, they are required to maintain regular contact with youth welfare offices and state authorities. A separate accreditation must be obtained for each partner country. Responsibility for granting licences lies with the relevant state youth welfare offices.

Responsibilities of the State Youth Welfare Offices

State youth welfare offices act as a backup agency for countries without independent providers. They also serve as supervisory authorities for accredited independent adoption agencies. These agencies must submit annual activity and financial reports, along with all child proposals, for review. Fees must be agreed in advance with the relevant state youth welfare office. Applicant couples must register with both the state youth welfare office responsible for their place of residence and the office responsible for the placing agency.

Federal Central Authority for Intercountry Adoption

All applicants are reported to the Federal Central Authority for Intercountry Adoption at the Federal Office of Justice in Bonn, which maintains a central register.

⚠️ Wichtig: Eine Auslandsadoption ist mit hohen Kosten verbunden – das Kind selbst jedoch „kostet“ selbstverständlich nichts!

Procedure in the Country of Origin

The first steps taken by the birth parents are: They contact the youth welfare office or children’s home and request the temporary admission of their child. After six to twelve months, a decision is made as to whether the child should remain in the home permanently or be released for adoption.

Assessment within the country: Firstly, consideration is given to whether domestic couples or relatives up to the third degree may be eligible.

Admission to intercountry adoption: Only when no domestic family can be found is the child entered into the international adoption database. The responsible local authority then selects a suitable couple.

Child proposal: The proposal is sent to the German adoption agency and, after translation, submitted to the responsible authorities.

Counselling of applicants:After the child proposal has been approved, applicants are invited to attend and receive all relevant documents. They then seek advice from the youth welfare office and obtain medical assessments. They only give their binding consent once they have received these documents and had these assessments, and they have it officially recorded at the youth welfare office.

Acceptance by the country of origin: The adoption agency will inform the country of origin and submit the required documents. After approximately 3 to 6 months, the prospective adoptive parents can travel to the country of origin to meet the child and bring them home.

The process of intercountry adoption is often unclear to the general public. As a result, adoptees are frequently asked thoughtless questions that can be hurtful.

As a general rule:

Birth parents typically place their children in a children's home several months or years before the adoption process begins.

An adoptive family is only selected once the child has been legally released for adoption.

The selection or matching process is carried out exclusively in the country of origin by the relevant professionals.

Meetings between birth and adoptive families only take place under the supervision of social workers or judges, usually during or after court proceedings have concluded.

It is often stipulated that the birth family will not initiate contact. However, if the child wishes to make contact later on, the birth family will usually respond.

The decision to give a child up for adoption is a very responsible one, driven by the desire to provide the child with the best possible conditions. Reasons for doing so can include a lack of family support, limited financial resources, an unstable housing situation or the need to continue education or training. Poverty or illness alone are not decisive reasons for releasing a child for adoption.
